End User License Agreement

Short version

You buy a personal license once. It covers every Mac you personally use, up to three at a time, forever, for the version you bought and its free updates. You may not share the key, resell it or take the app apart. If the software fails you, our liability is what you paid.

1. Parties and scope

This agreement is between you and Viacheslav Koniukhov, self-employed (the "author"), the copyright holder of Photo Transfer (the "software"). It covers the official builds of the software: the version downloaded from this website and the version distributed through the Mac App Store. For the App Store version, Apple's standard licensed application terms apply as well; where they conflict with this agreement, Apple's terms prevail for that version.

2. The license

Subject to this agreement, the author grants you a personal, non-exclusive, non-transferable license to install and use the software.

• Free tier. Without a purchase the software may be used free of charge with the limits shown in the application (a daily number of snapshots and no zip packing).
• Personal license. A purchase removes those limits for one person. You may install and activate the software on every Mac you personally use, up to three at the same time. To use it on another Mac, deactivate one first in the application's settings, or write to support if that Mac is no longer available.
• Household and business use. A personal license is for one person. A household with several people, or a business, needs one license per person who uses the software.
• Duration. The license is perpetual for the version you bought. It includes every free update to that version. The author may release a future major version as a separate paid product; your license to the version you bought is not affected.

3. The license key

The website version is unlocked with a license key issued after checkout and sent to the email address used at checkout. The key identifies your purchase and is yours to keep private. You may not publish it, share it, sell it or otherwise pass it on. A key found in public or on more Macs than the license allows may be revoked. A lost key is re-sent to the email address used at checkout on request.

The software confirms the key with the author's license service periodically and keeps working without a connection for 30 days from the last confirmation, after which it returns to the free tier until the next successful check. What is sent is described in the privacy policy.

4. Restrictions

You may not: copy the software except for backup; modify, decompile, reverse engineer or disassemble it, or attempt to derive its source code, except to the extent applicable law expressly permits; circumvent the license check or the free tier's limits; remove or alter any notice of ownership; or rent, lease, lend, sublicense or redistribute the software or the key.

5. Purchases, refunds and revocation

Purchases on this website are processed by Paddle as merchant of record, under its own terms of sale; your invoice and payment record are with Paddle. Purchases made on this website can be refunded in full within 30 days of purchase for any reason, as described in the refund policy. If you are a consumer in a jurisdiction with a statutory right of withdrawal, that right is honoured. A refund revokes the license key. Purchases in the Mac App Store are handled by Apple under Apple's terms, including refunds.

The author may revoke a key that is shared, published or obtained by fraud. In every other case a revocation is a refund, and a refund is at your request or as the law requires.

6. Updates and support

The website version checks for updates with the Sparkle framework and installs them with your consent, or automatically if you enable that in its settings. The App Store version updates through the App Store. Support is provided by email on a reasonable-efforts basis; there is no guaranteed response time.

7. Ownership

The software is licensed, not sold. The author retains all rights, title and interest in the software, its name and its icon. This agreement grants you no rights to the name or the icon. Third party components ship under their own licenses, listed in the application.

8. No warranty

The software is provided as is, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by applicable law. The software accesses the connected device read-only and verifies every copied file with a checksum; even so, you are responsible for keeping independent backups and for verifying that a transfer completed before relying on its result.

9. Limitation of liability

To the maximum extent permitted by applicable law, the author is not liable for any loss of data, loss of profit, or any indirect, incidental or consequential damages arising from the use of, or inability to use, the software. Where such exclusion is not permitted, the author's total liability is limited to the amount you paid for the license. Nothing in this agreement limits liability that cannot be limited by law, including for consumers under mandatory consumer protection rules.

10. Termination

This agreement is effective until terminated. It terminates automatically if you breach it. On termination you must stop using the software and delete your copies. Sections 4, 7, 8, 9 and 11 survive termination.

11. General

This agreement is the complete agreement between you and the author about the software and replaces any earlier understanding. If a provision is unenforceable, the rest remains in force. The agreement is governed by the law of the author's country of residence, without prejudice to mandatory consumer protection law where you live. Changes to this agreement are published on this page with a new date; they apply to purchases made after that date.
