1. What these terms cover

These terms apply to this website and to the official builds of Photo Transfer distributed from it and through the Mac App Store. By downloading or using the application you accept them.

2. Who sells the software

Photo Transfer is made and published by Viacheslav Koniukhov, self-employed (the "author"). Purchases on this website are processed by Paddle as merchant of record: Paddle.com Market Ltd for buyers outside the United States and Paddle.com Inc. for buyers in the United States. Paddle is the seller on your receipt and handles payment, taxes, invoices and refunds under its own terms of sale. The license to use the software is granted by the author under the End User License Agreement.

3. License

The official builds of Photo Transfer, the App Store version and the version sold on this website, are licensed to you, not sold, under the End User License Agreement. The App Store version is additionally subject to Apple's standard licensed application terms. Earlier versions of the project were published under the GNU General Public License, version 3 or later; the rights that license granted for those versions remain as they were.

4. Name and icon

The name Photo Transfer and the application icon identify the official builds and are not covered by the GPL grant to earlier versions. Forks and modified versions of those versions must be distributed under their own name and icon so that users are not misled about their origin.

5. Purchases and refunds

The price is shown on this website before checkout and is a one-time payment. Purchases made on this website can be refunded in full within 30 days for any reason; purchases made in the Mac App Store are refunded by Apple. The refund policy describes how to ask and what happens to the license key.

6. No warranty

The software is provided as is, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by applicable law.

The application is designed to be safe by default: it accesses the connected device read only and verifies every copied file with a SHA-256 checksum. Even so, it is your responsibility to keep independent backups of anything you care about and to verify that a transfer completed as expected before you rely on its result or free up space elsewhere.

7. Limitation of liability

To the maximum extent permitted by applicable law, the author is not liable for any loss of data, loss of profit, or any indirect, incidental or consequential damages arising from the use of, or inability to use, the software or this website. Where such exclusion is not permitted, liability is limited to the amount you paid for the software. Nothing in these terms limits liability that cannot be limited by law, including for consumers under mandatory consumer protection rules.

8. Acceptable use

You are responsible for having the right to access and copy the content you transfer, and for complying with the laws that apply to you. The application is a general purpose file transfer tool and does not inspect or moderate your content.

9. Third parties and trademarks

Purchases in the App Store are processed by Apple under Apple's terms. Apple, iPhone, iPad, Mac, macOS and App Store are trademarks of Apple Inc. This product is independent and is not affiliated with, sponsored by or endorsed by Apple. Paddle is a trademark of its owner.

10. Changes

These terms may be updated. The current version is always published on this page with the date of the last change at the top. Changes apply to purchases made after that date.
